<abstract>La prohibición del mérito como criterio de protección es un pilar fundamental en un terreno abonado para potenciales juicios de valor como lo es el de las creaciones literarias, artísticas y científi­cas: el más elemental principio de seguridad jurídica nos advierte de que no es el cometido de los órganos jurisdiccionales decidir, como areópagos artísticos, qué es arte y qué no lo es y enjuiciar según el mérito que les merece una fotografía o un fotógrafo. </abstract>
