<abstract displayLabel="Summary">If international reinsurers are to appreciate fully the risk of assuming business in the United States, they must fully appreciate the doctrine of punitive damages in the United States. Several excellent texts deal with the theory and application of the doctrine of punitive damages and the substantive law on a state-by-state basis. The purpose of this article is not to provide such detail but, following a brief overview of the American legal system and conflict of laws issues, to provide an overview of the complexity of the doctrine, particularly as it relates to reinsurance</abstract>
