<abstract>Las indudables ventajas que conlleva el nuevo sistema de ejecución provisional diseñado por la Ley de Enjuiciamiento Civil y que se concretan en el reforzamiento de la primera instancia y en una presunta disminución de la litigiosidad civil, no deben hacernos ocultar que la misma entraña una situación de riesgo que curiosamente ha sido soslayada de plano por la mayoría de la doctrina elaborada con relación a la nueva L.E.C.,  aduciendo razones tan faltas de consistencia como que los ejecutantes, por regla general, son más solventes que los ejecutados y que al no ser obligatoria la ejecución provisional el acreedor hará bien en no solicitarla, si tiene la creencia de que la sentencia se va a ver revocada en segunda instancia</abstract>
