<abstract>El respeto a la autonomía de la voluntad por parte del Código de Comercio y de la Ley de Contrato de Seguro, en lo que al Contrato de Seguro Marítimo se refiere, genera numerosos y complicados problemas de interpretación y de aplicación del mismo. El origen de dichos problemas radica, básicamente, en la paradójica práctica aseguradora española que consiste en superponer en un mismo contrato las condiciones generales del Instituto de Aseguradores de Londres y las condiciones generales españolas. Estos problemas son expuestos, aportandose soluciones concretas, y teniendo en cuenta las disposiciones especiales de la proyectada regulación de Contrato de Seguro Marítimo</abstract>
