<abstract displayLabel="Summary">El esfuerzo jurídico que debe realizar el demandante para probar su falta de culpa o negligencia en el accidente de circulación ha de ser tamizado por el órgano judicial, que será quien deba valorar positivamente su conducta. Una carga probática que se ha convertido en un obstáculo difícil de sortear cuando existe la más mínima duda acerca de las circunstancias en las que se produce el infortunio automovilístico. </abstract>
