<abstract>El ordenamiento jurídico español prevé una función administrativa denominada "resguardo fiscal del Estado". Este reconocimiento normativo, que tiene lugar en la Ley Orgánica 2-1986, de Fuerzas y Cuerpos de Seguridad del Estado, no ha sido objeto de un acabado y preciso desarrollo posterior, como seguramente hubiera sido de esperar. El artículo analiza detenidamente la normativa vigente y sus deficiencias</abstract>
