<abstract>El sistema legal otorga al empresario el poder de sancionar a sus empleados. No obstante, los cambios sociales están haciendo que se revisen pautas de comportamiento. Así, actuaciones, antes consideradas no adecuadas laboralmente hoy son entendidas como correctas y, por el contrario, aparecen nuevas conductas consideradas no tolerables. Pero este poder empresarial tiene una doble limitación: no puede sancionar aquello que no está regulado como falta y sus decisiones son revisables en vía judicial</abstract>
