<abstract displayLabel="Summary">La fijación de las indemnizaciones por los daños corporales derivados de accidentes de tráfico en España se lleva a cabo por acuerdo entre las partes (es decir, entre la compañía aseguradora del conductor culpable y la víctima) o mediante procesos judiciales. Los factores que inciden en las cuantías indemnizatorias finales tienen que ver fundamentalmente con las características de la víctima y las del accidente, y con los daños padecidos. Sin embargo, la incidencia de dichos factores puede no ser la misma cuando las compensaciones se fijan vía negociación o vía juicio. El objetivo de este trabajo ha sido determinar, teniendo en cuenta la vía de resolución del conflicto, qué variables poseen capacidad explicativa en las indemnizaciones concedidas a una muestra de 24.928 víctimas de accidentes de tráfico. Los resultados obtenidos con la modelización econométrica utilizada ponen de manifiesto la aparición de factores con influencia estadísticamente diferente en las indemnizaciones fijadas vía negociación y vía juicio</abstract>
