<abstract displayLabel="Summary">La sentencia del Tribunal de Justicia de la Unión Europea de 23 de octubre de 2012 (caso Marques Almeida) ha declarado que no se opone al Derecho de la Unión Europea, atinente a la regulación del seguro obligatorio de responsabilidad civil automovilística, la disposición nacional que, en un caso de colisión de dos vehículos en que no puede atribuirse culpa a ninguno de sus conductores, excluye (o reduce) su responsabilidad civil por los daños que sufra un pasajero por no llevar acoplado el preceptivo cinturón de seguridad; lo que determina que no opere (o que opere con reducción) la cobertura del seguro obligatorio que ampara esa responsabilidad civil. </abstract>
