<abstract displayLabel="Summary">En el transcurso de las últimas décadas, el marco regulador del reaseguro ha experimentado transformaciones signiificativas. En el plano estrictamente obligacional, se observa una tendencia caracterizada por el progresivo deterioro de la confianza entre los sujetos de la relación negocial. En este contexto, aparecen en el mercado las denominadas cláusulas "cut through" que han suscitado una viva polémica. La finalidad de las cláusulas "cut throuhg" consiste en atribuir al asegurado el derecho a exigir directamente al reasegurador el pago del importe de la indemnización que le corresponde en caso de que ocurra un siniestro cubierto por la póliza de seguro directo</abstract>
