<abstract>El derecho civil no ofrece respuestas generales frente a los daños ambientales y sólo resuelve conflictos entre particulares, cumpliendo así un papel subsidiario. El autor considera que los instrumentos del Derecho civil para la protección de los intereses privados frente a agresiones del medio ambiente son la acción de responsabilidad civil y la acción negatoria. También desempeña un papel importantte el seguro de responsabilidad civil frente a los daños medioambientales: la cobertura mediante seguro es impuesta como obligatoria para el ejercicio de determinadas actividades (transporte de hidrocarburos, energía nuclear, gestión de residuos...). En función de lo previsto en la póliza, este instrumento de Derecho privado puede ser una solución para la reparación tanto de los daños causados a particulares como a bienes ambientales de dominio público</abstract>
