<abstract displayLabel="Summary">Las consecuencias de los grandes siniestros ambientales, recientes y pasados, han despertado la necesidad de saber quién debe asumir los costes de limpieza de las zonas afectadas y la reparación de los daños. Esto es de especial relevancia en el caso de daños en recursos naturales "públicos". Los regímenes de responsabilidad, junto al principio de "quien contamina, paga", se presentan, así, como instrumentos con gran potencial. En la primera parte de este artículo se analiza la evolución de la legislación en materia de responsabilidad medioambiental en Estados Unidos y en la Unión Europea, con especial atención a España y Portugal</abstract>
