<abstract displayLabel="Summary">La Ley General de Seguridad Social, en el apartado tercero del artículo 115, establece una presunción de laboralidad de todo percance sufrido por un trabajador en tiempo y lugar de trabajo. Se invierte la carga de la prueba y se trata, en definitiva, de resolver a favor de la parte más débil, en aplicación del principio "in dubio pro accidentado" en aquellos supuestos en los que no se puede tener la plena certidumbre de la existencia del nexo causal entre el accidente y la lesión</abstract>
