<abstract displayLabel="Summary">La declaración de un vehículo como pérdida total es uno de los momentos que provocan mayor controversia entre asegurado y asegurador en el ramo de automóviles. Se ven enfrentados los intereses del asegurador - que intenta, lógicamente, minimizar las consecuencias del siniestro en términos económicos - y los del asegurado - que pretende ver restituido su patrimonio al estado inmediatamente anterior al siniestro -. La STS 420/2020, de 14 de julio intentó hacer confluir en un punto intermedio las teorías de la restitutio in integrum y del enriquecimiento injusto atendiendo a las circunstancias concretas del caso</abstract>
