<abstract>Le présent document porte plus sur le rôle de l'État par rapport au risque que sur l'industrie de l'assurance. La modification des risques, en partie liée à l'action de l'État lui-même, suppose en effet une adaptation de l'intervention publique dans le champ de l'assurance. Elle passe para une meilleure prise en compte du risque et de sa gestion. Il s'agit donc d'interroger l'État sur ses missions concernant la bonne fin des contrats d'assurance, sans vouloir opposer un État garant, ou surveillant, ou encore bienveillant, à un secteur de l'assurance qui pourrait devenir menacé ou fragilisé, ou pire encore. Ainsi, l'accent est mis dans cette étude sur les cas extrêmes, avec l'idée de s'y préparer et surtout de les éviter</abstract>
