<abstract displayLabel="Summary">El documento analiza el régimen jurídico aplicable en España a las operaciones de pago no autorizadas por fraude de terceros, centrándose en los derechos y obligaciones de los usuarios y proveedores de servicios de pago según el Real Decreto-ley 19/2018 y la Directiva (UE) 2015/2366. Examina las técnicas de fraude más comunes (phishing, smishing, vishing), el marco legal de responsabilidad, y cómo las Audiencias Provinciales han interpretado estos casos, generalmente favoreciendo al usuario salvo negligencia grave. Se identifican cuestiones abiertas como la definición de negligencia grave, la insuficiencia de medidas de seguridad por parte de los proveedores, y la necesidad de una reforma normativa que clarifique conceptos y responsabilidades. Finalmente, se reflexiona sobre la necesidad de mejorar la educación financiera, establecer estándares claros de diligencia, y crear mecanismos ágiles de resolución de conflictos para proteger eficazmente a los consumidores frente al fraude digital</abstract>
