<abstract displayLabel="Summary">A raíz de la sentencia del 13 de diciembre de 2007 del Tribunal de Justicia de la Unión Europea (asunto 463/06), que estableció la habilitación del foro jurisdiccional a favor de los juzgados y tribunales competentes en el lugar de residencia del Estado miembro donde la víctima tiene su residencia habitual para conocer de las acciones directas contra un asegurador de otro Estado miembro, que se originó en su día debido a una cuestión de prejudicialidad presentada por el Tribunal Federal Superior Alemán (BGHBundesgerichtshof, asunto VI ZR 200/05), se ha abierto una nueva vía estratégica y fáctica de reclamar directamente en Alemania cualquier daño -material o corporal-  ocasionado a un residente en Alemania en un accidente de circulación en España. </abstract>
