| 520 | | | $aThe actuary is an expert whose task in litigation is usually to fix a lump sum to represent adequately the present value of a future income stream. Until relatively recently, actuaries were usually only retained in fatal accident cases. In 1978, the Supreme Court of Canada imposed an arbi trary limit, to be increased only by the effect of inflation, on the amount of general damages to be awarded for pain and suffering and loss of the amenities of life: Andrews, Teno and Thornton, [1978] 2 S.C.R. This limit properly focused the attention of the legal profession and the judiciary on ensuring that plaintiffs are adequately compensated for their future pecuniary losses and expenses, with the result that actuarial reports and the evidence of actuaries now play an essential part in the assessment of nearly all cases of serious injury. Counsel have become used to working with actuaries and the employment of actuaries by counsel has spread outside the personal injury field to such matters as the valuation of future interest in divorce, wrongful dismissal, estates and businesses. Donald Anderson's book, so far as I know, is the only book available on actuarial evidence. It is excellent, and should be required reading for all counsel. I was particularly impressed by Mr. Anderson's insistence that actuaries as witnesses and in their reports be there "to assist the Court in its search for justice, and not to present a biased view". |
