<abstract displayLabel="Summary">El documento analiza exhaustivamente la naturaleza jurídica de las criptomonedas, concluyendo que no pueden considerarse ni dinero de curso legal, ni instrumentos financieros, ni fichas de dinero electrónico ni criptoactivos referenciados a activos según el Reglamento MiCA. En cambio, propone que las criptomonedas deben entenderse como instrumentos de pago contractuales, válidos en relaciones privadas si las partes así lo acuerdan, aunque no tengan reconocimiento oficial como medio de pago general. El texto examina las implicaciones jurídicas, fiscales y regulatorias de esta clasificación, destacando la exclusión de las criptomonedas del régimen tuitivo europeo y su encaje en el derecho privado común, así como los desafíos que plantea su descentralización, volatilidad y falta de regulación específica</abstract>
